§ 32-67. Restoration of street surface, etc.

  • (a)

    In the event a permit is revoked, the permit holder shall immediately commence operations to restore the work area within the street to its proper condition, such work to be completed within twenty-four (24) hours. Except as required to restore the work area, the permit holder shall remove all equipment, men, materials, and debris from the street.

    (b)

    In the event such restoration is not done with the time allowed herein, the city shall be authorized at its own election to take charge of the work and to restore the site to its proper condition, and the city shall be entitled to recover from the permit holder actual expenses incurred by the city in such restoration, including but not limited to the costs of labor, materials, equipment charges or overhead. For such purposes, the city shall have a right of action against any bonds in effect running from the permit holder to the city, conditioned upon compliance with ordinances of the city in the performance of said work.
