§ 10.405. APPLICABILITY OF TND REGULATIONS, VARIANCES

A.

The standards requirements and procedures of other applicable City ordinances shall apply to a TN, unless specifically modified or amended by this TN ordinance, or through variances granted by the Zoning Board of Adjustments (ZBA), as provided herein. The ZBA may grant variances to these regulations and/or to the zoning regulations generally, provided that: (a) actions, designs or solutions proposed by the Applicant, although not literally in accord with these TN regulations or with the City's zoning and subdivision regulations, satisfy the intent and purpose of TN's at least to an equivalent degree; (b) the ZBA determines that the proposed modifications promote the health, safety, appearance, and general welfare of the community.
