§ 32-64. Approval or disapproval of permit.

  • (a)

    The safety officer will approve, disapprove or approve subject to certain requirements every application within five (5) business days after its submission. If an application is not approved, the safety officer shall notify the applicant in writing of such action and state the reasons therefor. Any applicant may amend his application and resubmit same for approval not less than two (2) days prior to beginning work.

    (b)

    The safety officer may disapprove an application for permit under this section for the following reasons:

    (1)

    The proposed barricading, signing warning or other traffic-control devices or procedures do not conform to the manual.

    (2)

    The nature of the work to be performed or its location is such that the work may, without imposing any undue hardship on the applicant, be performed without the need to close or block any public right-of-way.

    (3)

    The work proposed, or the manner of its performance is or would be in violation of any ordinance or other law.

    (4)

    Misrepresenting or falsifying any information on the application or failure to provide the information required by this section within the time prescribed.
