§ 14-50. Inspection.

  • (a)

    The administrator may inspect the work at any development site subject to this article and may either approve that portion of the work completed or notify the owner and/or operator that the work fails to comply with an approved erosion and sediment control plan. Plans for grading, stripping, excavating and fill work bearing the stamp of approval of the administrator shall be maintained at the site during the progress of the work.

    (b)

    The owner or the owner's agent shall inspect all control measures in accordance with the inspection schedule set forth in the approved erosion and sediment control plan. The purpose of such inspections will be to determine the overall effectiveness of the control plan and the need for additional control measures. All inspections shall be documented in writing and submitted to the administrator as specified in the permit.

    (c)

    The administrator may enter the property of the owner and/or operator as necessary to make inspections to ensure the validity of the reports filed pursuant to subsection (b) of this section. The operator shall allow the administrator to enter the property at any reasonable time as the administrator deems necessary to make inspections to ensure the validity of the reports filed pursuant to subsection (b) of this section.

    (d)

    If the administrator determines that the operator refused to allow the administrator to enter the property to make his inspection at a reasonable time, he shall notify the city manager of the refusal in writing with a copy to the operator. The notice shall identify the property, and state the date and time that entrance was requested and denied. The notice shall also state that the owner and operator may appeal the determination within ten (10) business days, in the same manner for appeals set out in division 5. If the operator does not appeal the administrator's determination timely, or if the city manager upholds the administrator's determination after hearing, the city manager may suspend all permits required for the development. The suspension of all permits may be lifted by the city manager if the operator allows the administrator to enter the property to make his inspection within three (3) business days of the city manager's decision. Otherwise new permits must be obtained.
