§ 34-313. Penalty.

  • (a)

    The city council has determined that this article is necessary to protect health, life, and property and to preserve good government, order, and security of the city and its inhabitants.

    (b)

    An owner, operator, or employee commits an offense if the person violates this article or fails to comply with a requirement of this article.

    (c)

    An offense under this article is a class C misdemeanor, punishable by a fine not to exceed five hundred dollars ($500.00) per offense. Each day shall constitute a separate offense.

    (d)

    Proof of a culpable mental state is not required for a conviction of an offense under this article.

    (e)

    The provisions of this article are cumulative of other remedies.

    (f)

    Each day or portion of a day during which a violation occurs or continues constitutes a separate offense.

    (g)

    The city may seek to enjoin violations of this article, and may file suit for the recovery of all expenses incurred, including without limitation, administrative and legal expenses, attorneys' fees, and costs, and for civil penalties as provided by law.
