§ 32-62. Permit required.

  • (a)

    Any person who undertakes to perform any work upon, in, under, above or about any public right-of-way which requires that such right-of-way be closed or partially closed for such work or for the occupancy of such right-of-way by equipment, debris or workmen shall, before commencing such work, apply for and receive a permit from the safety officer as required by this section.

    (b)

    Upon issuance of such permit, it shall be the duty of the permit holder to provide, erect, place and maintain all warning signs, traffic-control devices and barricades as required by the manual or by the safety officer. All such signs, devices and barricades shall be in good condition, clean and legible.

    (c)

    Construction work performed by city forces or utility companies which is minor in nature and requires the preparation of no formal plans shall not require a permit to be issued. However, such work forces shall be required to:

    (1)

    Notify the safety officer of the location and nature of the work to be done prior to beginning work;

    (2)

    Perform no such work between the hours of 7:00 a.m. and 8:30 a.m. or 4:00 p.m. and 6:00 p.m. on any major arterial or collector street; and

    (3)

    Comply with all other provisions of this article and the manual as to signing, barricade layout or special instructions of the safety officer.

    (d)

    Construction work performed by city work forces or a utility company having a franchise agreement with the city of such an extent or nature as to require the preparation of construction plans shall be subject to all requirements of this article, including the requirement of a permit.

    (e)

    In the event a contractor or other person undertakes work based on plans prepared by any city department, such plans shall include all requirements for detours and barricades.

    (f)

    Any person undertaking any work, whether his own or under contract to another person, within a public right-of-way must apply for a permit before beginning construction. Such application shall include proof that approval for such work has been obtained from any other affected city department actually to perform such work.

    (g)

    Every such application shall be accompanied by a barricade plan, prepared by the applicant, showing where work is to be performed, together with the planned placement of all signs, cones, barricades, or other devices to be used to guide and direct traffic through or around the construction area. Signs, barricades, or other devices not in conformance with the manual shall be allowed only with the written approval of the safety officer. Such barricade plan shall be submitted to the safety officer at least five (5) business days prior to actual beginning of work.

    (h)

    The barricade plan shall include a listing of all persons directly responsible for traffic safety on each project, including a telephone where each may be contacted, whether day or night.

    (i)

    Work crews of the state department of highways and public transportation, when working on designated state highways within the city, shall be exempt from the provisions of this article.
