§ 32-49. Maintenance of track and roadbed.

  • (a)

    All tracks owned or used by a railroad company, unless otherwise specially authorized or directed by the city council, shall be maintained on a level with the surface of the street occupied by such tracks and kept in such manner with reference to such streets as will not unnecessarily inconvenience, impede or interfere with their use by the public.

    (b)

    At all curves and street intersections or crossings, railroad companies shall maintain their roadbed and tracks, and the approaches thereto, for the full width of the street, in good, safe and passable condition for vehicles.
