§ 2-342. Definitions.

  • Minority and women-owned business enterprises (M/WBE) are defined as follows:

    (a)

    Minority business. Any sole proprietorship, partnership or corporation that is owned, managed and controlled by a citizen or lawful resident of the United States and whose majority ownership (51%) has been certified to be owned, managed and controlled by socially or economically disadvantaged individuals who are Black Americans, Hispanic Americans, American Indians, Alaskan Natives, Asian-Pacific Americans or Asian-Indian Americans.

    (b)

    Women-owned business. A business (sole proprietorship, partnership or corporation) whose majority ownership is fifty-one (51) percent and has been certified to be owned, managed and controlled by women, or in the case of any publicly owned business at least fifty-one (51) percent of the stock of which is owned by one or more women and whose management and daily business operations are controlled by them.

    (c)

    Bidder/proposer. Any person, firm or legal business entity which submits a bid or proposal to provide products or services to the City of Galveston by contractual agreement.

    (d)

    Contractor. Any person, firm or legal business entity providing products or services to the City of Galveston by contractual agreement.

    (e)

    Goal-oriented contract. Any contract, agreement or other undertaking anticipated for construction work to be in excess of ten thousand dollars ($10,000.00). Contracts and procurements for the supply of products or professional services shall be analyzed on a departmental basis and the goals for all minority and women-owned business participation shall be (1) re-evaluated at the beginning of the City of Galveston's fiscal year; and (2) a strong effort should be made to improve upon the minority/women-owned business participation goal for the prior year.

    (f)

    Owned, managed and controlled. One or more minority persons or women who hold the majority interest in a business shall have recognized ultimate control over the day-to-day business decisions and operations affecting the MBE or WBE and shall hold a title in the business commensurate with such control.
