§ 23-101. Permit requirements; exceptions.

  • It shall be unlawful, except as specifically provided by this article VI, for any person to deposit or dump on any property, or for any person to allow to be deposited or dumped on any property, any dirt or other fill materials without first obtaining a dumping permit from the department.

    The provisions of this article VI shall not apply to:

    (a)

    Persons depositing or dumping and spreading dirt, sand or other gardening materials on the premises used in connection with an existing building for landscaping purposes;

    (b)

    The dumping of sand or other building material on a lot in connection with construction of improvements in progress for which a building permit has been obtained;

    (c)

    The dumping or depositing of dirt, sand, fill material, refuse, garbage, brush or junk for which a permit has been obtained under other provisions of the city Code; or

    (d)

    The dumping or depositing of such materials in a city dumping ground so designated by the city.
