§ 16-31. Transfer of city-owned property to the management of the board of trustees of the Galveston wharves.

  • (a)

    That certain city-owned Pelican Island property described below is hereby transferred to the board of trustees of the Galveston wharves for the management, maintenance, operation and control of such properties as set forth in Article XII of the Charter of the City of Galveston, Texas:

    A parcel or tract containing 214.2382 acres being all of those called five tracts comprising lease parcels being known as Tract I (five parcels being called Parcel "A" containing called 2.98 acres; Parcel "B" containing called 11.32 acres; Parcel "C" containing called 9.14 acres; Parcel "D" containing called 88.19 acres; and Parcel "E" containing called 63.62 acres), Tract II containing called 37.02 acres, Tract III containing 24.9983 acres "save and except" 23.8500 acres as described in Book 3231, Page 388 in the Galveston County Deed Records, Tract IV containing called 0.4734 acre tract being that same 0.4734 acre tract described in Book 2253, Page 10 of the Galveston County Deed Records, and Tract V containing called 3.44 acres as described in Book 307, page 100 of the Galveston County Deed Records, and also being part of and out of land on Pelican Island or Spit, in the City of Galveston, County of Galveston, Texas; said 214.2382 acres being more particularly described by metes and bounds as follows:

    Beginning at a four-inch plug pipe filled with concrete found marking the northeast corner of the said called 88.19 acre tract, being that same monument cited by Paul Milligan, P.E., on map or plat of survey dated and revised on May 10, 1945, with called coordinates of X=3,339,012.85 and Y=565,300.75 as referenced to the Texas Coordinate System (South Central Zone), said beginning point also being the northerly corner of said called 24.9983 acre tract, on the south line of a forty-foot wide drainage easement as described in Volume 1889, Page 607 of the Galveston County Deed Records;

    Thence, south 16°25′46″ east (called south 18°30′17″ east, as referenced in deed call to the Texas Coordinate System, South Central Zone), along the easterly line of said called 88.19 acre tract, same being the westerly line of said called 24.9983 acre tract, for a distance of 1,787.41 feet to a five-eighths-inch iron rod set for corner, same being a re-entrant corner of the aforesaid called 23.8500 acre tract as described in Book 3231, Page 388 of the Galveston County Deed Records;

    Thence, south 62°03′39″ west, along the northerly line of said called 23.8500 acre tract, for a distance of 174.77 feet (called 173.63 feet) to a five-eighths-inch iron rod set for corner, same being the easterly line of the said called 88.19 acre tract;

    Thence, south 27°51′16″ east, along the common line for the said called 88.19 acre tract and the called 24.9983 acre tract, for a distance of 1,349.20 feet (called 1,347.73 feet) to a point for corner, same being the southeast corner of the aforesaid called 9.14 acre tract (Tract I, Parcel "C"), on the called U.S.E.D. Harbor Line;

    Thence, in a general southwesterly direction, along the called U.S.E.D. Harbor Line (as cited on the aforementioned map or plat prepared by Paul Milligan, P.E., on May 10, 1945) with calls as follows:

    South 62°08′44″ west—798.27 feet;

    South 77°08′44″ west—1,286.19 feet; and

    South 89°50′14″ west—641.39 feet

    to the southeast corner of a called 3.44 acre tract conveyed to the City of Galveston and being that same tract described in Book 3177, Page 97 of the Galveston County Deed Records;

    Thence, north 16°25′46″ west, along the easterly line of said called 3.44 acre tract, for a distance of 382.32 feet (called 380.17 feet) to a five-eighths-inch iron rod set for corner, same being the northeast corner of said called 3.44 acre tract;

    Thence, south 89°32′58″ west, along the northerly line of said called 3.44 acre tract, for a distance of 410.00 feet to a five-eighths-inch iron rod set for corner, same being the northwest corner of said called 3.44 acre tract;

    Thence, north 16°25′46″ west, along the westerly line of the aforesaid called 63.62 acre tract (Tract I, Parcel "E"), for a distance of 2,547.83 feet to a five-eighths-inch iron rod set for corner, same being the northwesterly corner of said called 63.62 acre tract;

    Thence, north 73°34′14″ east, along the northerly line of said called 63.62 acre tract, at 780 feet pass a four-inch plug pipe filled with concrete, being the common northerly corner of said called 63.62 acre tract and 88.19 acre tract, and continue for a total distance of 2,645.39 feet to a five-eighths-inch iron rod set for corner, same being the southwest corner of aforesaid called 0.4734 acre tract;

    Thence, north 16°14′34″ west, along the westerly line of said called 0.4734 acre tract, for a distance of 412.54 feet to a five-eighths-inch iron rod set for corner, same being the northwest corner of said called 0.4734 acre tract, on the southerly right-of-way line of Sea Wolf Parkway (formerly Pelican Island Boulevard);

    Thence, north 73°45′26″ east, along the southerly right-of-way line of Sea Wolf Parkway, same being the northerly line of said called 0.4734 acre tract, for a distance of 50.00 feet to a five-eighths-inch iron rod set for corner, same being the northwest corner of a called 0.6657 acre tract as described in deed recorded in Book 3135, Page 856 of the Galveston County Deed Records;

    Thence, south 16°14′34″ east, along the common line of said called 0.4734 acre tract and 0.6657 acre tract, for a distance of 412.37 feet to a five-eighths-inch iron rod set for corner, on the northerly line of said called 88.19 acre tract;

    Thence, north 73°34′14″ east, along the northerly line of said called 88.19 acre tract, for a distance of 284.61 feet to the place of beginning, of a tract containing 214.2382 acres.

    (b)

    As consideration for the transfer of the property described above, the board of trustees of the Galveston wharves shall pay to the city the sum of $12,000.00 per year.

    (c)

    That certain city-owned Pelican Island property described below is hereby transferred to the board of trustees of the Galveston Wharves for the management, maintenance, operation and control of such property as set forth in article XII of the City Charter:

    That certain tract of land on Pelican Island (sometimes known as "Pelican Spit"), in Galveston County, Texas, situated in the southwesterly corner of Lot One (1), Range Twenty-eight (28) as shown on the map adopted by the Board of City Commissioners of Galveston and recorded in Book 254, page 62 of Galveston County Records, more particularly described as follows:

    Beginning at a point in the west boundary line of Lot 1, Range 28, which line is also the east boundary of Twenty-Ninth Street, said point being in the center of a concrete marker cast within a 4" iron pipe located about 55 feet landward of the average tide shoreline, said point having the coordinates (X = 3,337,063.39; Y = 561,726.50), referred to the Texas Plane Coordinate System, South Central Zone, as established by the United States Coast and Geodetic Survey in 1934;

    Thence North 16° 25' 45.8" West 229.52 feet along the east boundary of the said Twenty-Ninth Street to a point marked by a 1" iron pipe;

    Thence North 89° 32' 58.3" East 410 feet to a point marked by a 1" iron pipe;

    Thence South 16° 25' 45.8" East 380.17 feet to a point in the U.S. Government Harbor Line, which point is in a line which bears South 89° 32' 58.3" West from U.S. Government Harbor Line Point No. 9;

    Thence South 89° 32' 58.3 West 410 feet along the U.S. Government Harbor Line (approved by Ass't Secretary of War September 24, 1921, and reapproved by the Secretary of War September 19, 1939, as indicated on Corps of Engrs., U.S. Army harbor line map dated May 1939, File No. GALV. 306-16, on file in the office of the Chief of Engineers, Corps of Engineers, U.S. Army, Washington, D.C.) to a point in the U.S. Government Harbor Line;

    Thence North 16° 25' 45.8" West 150.65 feet along the east boundary of the said Twenty-Ninth Street to the Point of BEGINNING. Containing 3.44 acres of land more or less.

    (d)

    As consideration for the transfer of the property described in subsection (c), the board of trustees of the Galveston Wharves shall pay to the city the sum of ten thousand dollars ($10,000.00) per year.
