§ 15-3. Containers generally.

  • (a)

    Receptacles for refuse shall be limited to city issued automated carts. All garbage and trash shall be placed within the automated cart in such a way as to allow the lid to close. Should any location, in the opinion of the director of municipal utilities or his designee, regularly generate more garbage and trash than will fit into an automated cart, the director may require additional cart(s) for the location. That person responsible for making the payment of fees for collection under this Code shall also be responsible for maintaining the receptacles in a clean and sanitary manner.

    (b)

    Receptacles for recycling shall be provided by private residential recycling haulers with the approval of the director of municipal utilities, or his designee. All recyclable material shall be placed securely within the receptacles provided and set out for collection as provided below, on days approved by the director of municipal utilities, or his designee.

    (c)

    Receptacles located within private property will not be serviced. Instead, receptacles shall be placed for collection in one (1) of the following locations at the direction and discretion of the director of municipal utilities, or his designee.

    (1)

    Adjacent to the curb of the street in front of the property being serviced;

    (2)

    In the alley at the rear of the property being served;

    (3)

    In areas where no street curbing exists and surface drainage is conducted through open roadside ditches, the point of collection shall be on the shoulder of the street between the edge of the pavement and the drainage ditch. No container shall ever be placed for collection in such location as to interfere with the normal flow of surface drainage along and through drainage ditches.

    (4)

    At any other location, as determined by the director of municipal utilities, or his designee, that will benefit the efficient and effective collection of garbage and trash and/or recyclable material.

    (d)

    All receptacles shall be set out for collection prior to 6:30 a.m. on the regular day of collection whether for refuse or for recyclable material, but no sooner than 5:00 p.m. of the day prior to collection. Where possible, as determined by the director of municipal utilities or his designee, all receptacles shall be returned to private property, secured and screened from view as soon as practicable after servicing, but, in no case later than 10:00 p.m. of the day of service. The director of municipal utilities may allow receptacles to remain in alleys when appropriate.

    (e)

    Notwithstanding anything to the contrary contained above, the director of municipal utilities or his designee, in instances of mental or physical infirmity of the customer or other appropriate circumstances of severe hardship, may authorize receptacles and containers to be placed for collection in such location as he may designate, including upon private property.
