§ 14-47. Submission of notice of intent.

(a)

The owner or operator of a facility required to have a NPDES or TPDES permit to discharge storm water associated with construction activity shall submit a certification that the owner or operator has submitted a notice of intent to the EPA or TCEQ, a copy of that notice of intent, and a copy of a site plan detailing the location of erosion control measures shall be provided to the administrator prior to obtaining a construction permit for that activity.

(b)

A person commits an offense if the person operates a facility that is discharging storm water runoff associated with construction activity without having first submitted a copy of the notice of intent related to such discharge to the city.
