Upon written application to the fire marshal, by the affected individual, the fire
marshal, after considering said application, shall have the discretion to waive any
of the provisions of the fire prevention code when there is shown to exist practical
difficulties in the enforcement of the code; provided, however, that the spirit of
the code is maintained, the public safety is secured, and substantial justice is done.
The particulars of such modification, along with the decision of the fire marshal,
shall be entered upon the records of the department of fire prevention, and a copy
shall be furnished to the applicant.
