§ 10-31. Means of appeal—Right to appeal.

  • Except as otherwise provided in section 10-32; this section references an appeal from a decision of the building official and this chapter.

    Any person directly affected by a decision of the code official or a notice or order issued under the code shall have the right to appeal to the board of adjustments and appeals, provided that a written application for appeal is filed within thirty (30) days after the decision, notice or order was served. An application for appeal shall be based on a claim that the true intent of the code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of the code do not fully apply, or the requirements of the code are adequately satisfied by other means.
